Standard Terms and Conditions

Outside Expenses

If outside expenses for services like printing, photography, illustration, copywriting or postage are needed, they will be discussed and agreed upon before being incurred. These expenses may be billed separately upon completion of the project, or included in David & Company’s monthly billing, in the case of lengthy projects.

A minimum service fee of 15% will be added to all outside expenses billed through David & Company.

Terms

David & Company’s standard terms include a down payment equal to 50% of estimated total fees for design and production, using the lowest figure when a range of fees is offered. The balance is due upon completion, before files are released. If printing is to be handled by David & Company, all fees for printing will be due before placing the order.

Once work has begun, the down payment is non-refundable.

Terms for hosting or site maintenance are covered in the hosting or maintenance agreement.

Conditions

Should the project be canceled before completion, a cancellation fee of no less than 50% of estimated fees will be retained and reimbursement for time spent and outside expenses, previously agreed upon and incurred to date, will become due.

Copyrights for original work created by David & Company will be retained by David & Company until ownership of final files passes to the client upon completion of the project and full payment has been made. Preliminary files not used in the final work, will remain the property of David & Company. This arrangement does not cover copyrights for outside or contracted creative work, such as photography. David & Company reserves the right to use representations of work done for you in our marketing and promotional efforts, whether in print or on the web.

Fonts have their own licensing requirements.
